Updated FAQ (2026) about Divorce in Cyprus

Divorce in Cyprus requires a court decision, even where both spouses agree that the marriage should end.

1. How do I apply for a divorce in Cyprus?

The first step is to establish whether the Cyprus courts have jurisdiction and which ground for divorce applies. The marriage certificate must also be reviewed, together with any requirement to complete a religious notification procedure before filing.

The application is filed with the competent Family Court and sets out the ground for divorce and the facts supporting it. If you are applying against your spouse, the papers must be formally served on them so that they have an opportunity to respond.

2. Can I get divorced in Cyprus if I am not Cypriot?

Yes, provided the Cyprus courts have jurisdiction. This depends on each spouse’s habitual residence, nationality and, in some cases, how long they have lived here. A residence permit alone does not establish jurisdiction. We assess both spouses’ residence histories, including the duration of their residence and any recent move.

3. We married abroad. Must we divorce in that country?

Not necessarily. A marriage celebrated abroad can be dissolved in Cyprus if the courts here have jurisdiction. Equally, marrying in Cyprus does not automatically entitle you to obtain a divorce here while living abroad. Any divorce proceedings already started in another country must also be considered before filing in Cyprus.

4. What are the main grounds for divorce?

The main grounds are serious breakdown of the marriage, separation for at least two years and mutual consent.

For serious breakdown, the reason must relate to the other spouse or both spouses, and the relationship must have deteriorated to the point that continuing the marriage is reasonably intolerable for the applicant. An application on this ground must set out the relevant facts, which may need to be proved in court.

5. Do we have to be separated for two years before applying?

No. You can apply sooner if you satisfy the requirements of another ground for divorce.

If you rely on the two-year separation ground, the law treats the breakdown of the marriage as conclusively established. Brief interruptions for attempted reconciliation do not prevent the two-year period from being completed, provided they do not exceed three months in total. The separation date and any attempts to resume the relationship should therefore be established before filing.

6. Can we apply jointly if we both want a divorce?

Yes. You can make a joint application, or one spouse can apply with the other’s consent. For a consensual divorce, at least six months must have passed since the wedding before the application is filed. Both spouses must consent freely and declare that consent before the court. A private agreement between the spouses does not itself dissolve the marriage.

7. Can we get a consensual divorce if we have children?

Having children does not prevent a consensual divorce. If you have minor children, you must file either a copy of an existing court decision on custody or contact, or an application for an agreed decision on those issues. Where an agreed decision is sought, it must be issued at the same hearing as the divorce.

Any existing custody or contact order should be reviewed at the outset. A private agreement about the children does not, by itself, meet the requirement for a court decision.

8. What if my spouse refuses to agree to a divorce?

You do not need your spouse’s signature to begin contested divorce proceedings. Without their consent, however, you must apply on another available ground and establish it before the court. Your spouse is entitled to defend the application and challenge your evidence. The court will decide whether you have proved the ground for divorce.

9. Must I notify the Bishop before filing?

For a marriage celebrated according to the rites of the Greek Orthodox Church, notification to the competent Bishop is generally required before filing. If six weeks pass from the Bishop’s receipt of the notification without the relevant certificate being issued, either spouse may file the divorce application. Where a certificate is issued earlier, it should be reviewed to determine when the application may be filed.

There are exceptions. One concerns divorce sought on the ground of marital breakdown involving domestic violence by the other spouse against the applicant or a child. An official complaint must have been made to the Police or Social Welfare Services, and the relevant confirmation must have been issued.

This notification is not required for a purely civil marriage. For other religious marriages, the applicable procedure needs to be considered separately.

10. What documents will be needed?

For the initial review, we need your marriage certificate and identification, both spouses’ current addresses and residence histories, and a brief account of the circumstances leading to the divorce. The relevant dates, particularly the date of separation, are also important.

We may also need proof of religious notification, children’s birth certificates and any custody or contact order. A foreign marriage certificate may need to be translated or authenticated, depending on where it was issued.

11. Can I divorce in Cyprus if my spouse lives abroad?

Yes, if the Cyprus courts have jurisdiction. The application must still be properly served. The method of service depends on the country concerned and may involve translations and further procedural steps.

To arrange service, we need the most accurate address available and details of any lawyer acting for your spouse. Emailing or messaging the papers does not necessarily amount to valid service. Service abroad can also add to the time and cost of the case.

12. What if my spouse avoids service or ignores the papers?

If your spouse cannot be served in the usual way, you can ask the court to authorise another method. The court will need evidence of the attempts made to find or serve them.

If your spouse has been properly served but does not take part, the court may hear the case in their absence, provided the procedural safeguards are met. You must still establish your entitlement to a divorce. Their failure to respond does not count as consent.

13. Will I need to attend court?

You should expect to attend where the court requires your evidence or personal confirmation. For a consensual divorce, both spouses must declare their consent before the court. In other cases, attendance depends on how the application proceeds and what the court directs. For clients living abroad, attendance arrangements should be confirmed before travel is booked.

14. How long does a divorce take?

A consensual or undefended divorce generally involves fewer procedural steps than a contested case involving evidence and cross-examination. There is, however, no fixed timetable. Court availability, service of the papers and any procedures that must be completed before filing can affect the duration of the case. We can provide an estimate after reviewing the documents and establishing whether your spouse intends to oppose the application.

15. How much will it cost?

Fees depend on the work required, particularly whether the divorce is contested. Service overseas, disputed evidence and additional hearings can increase the cost. We provide a quotation after reviewing the circumstances of the case. This should clarify whether court fees, service expenses, translations and VAT are included, and how the fees may change if an agreed divorce becomes contested.

16. When can I remarry?

You must wait until the appeal period has expired and the divorce is final. If an appeal is filed, the dissolution of the marriage is suspended until the appeal is decided.

Plans for remarriage should be based on confirmation that the divorce is final and that the necessary documents are available. The court’s announcement of its decision is not sufficient on its own. Where the wedding will take place abroad, the requirements of the authorities in that country must also be checked.

17. Will my Cyprus divorce be recognised abroad?

A Cyprus divorce judgment is generally recognised in other EU Member States without a separate recognition procedure, although there are exceptions. Denmark is outside this regime. You will normally need the judgment and the appropriate court certificate, and a translation may also be required.

For the United Kingdom and other non-EU countries, recognition depends on the relevant local rules and any applicable treaty. Where the judgment is needed for a wedding or an official registration abroad, the documentation requirements should be considered before the proceedings conclude.

How we can help

A. Danos & Associates LLC advises and represents clients in consensual and contested divorce proceedings before the Cyprus Family Courts, including cases where a spouse lives abroad. We assess jurisdiction, advise on the appropriate ground for divorce and handle the court proceedings. For an initial assessment, we need the date and place of marriage, where each spouse now lives, and whether both agree to divorce.
