Effective January 1, 2026, Article 20E of the Cyprus Income Tax Law establishes a dedicated, ring-fenced flat rate of 8% on net profits derived from the disposal of crypto-assets for both individuals and companies.

Core Framework of Article 20E

  • The Flat Rate: A mandatory 8% tax applies to net gains from crypto-asset disposals, replacing older, uncertain “badges-of-trade” interpretations that previously taxed trading profits up to 35% for individuals or standard corporate rates.
  • Definition of Crypto-Assets: The law aligns directly with the EU Markets in Crypto-Assets (MiCA) regulation.
  • Taxable Disposals: A disposal is triggered by:
    • Selling crypto-assets for fiat currency (e.g., EUR or USD)
    • Swapping one crypto-asset for another (crypto-to-crypto trades)
    • Using crypto-assets to purchase goods or services
    • Gifting or donating crypto-assets
    • Protocol redemptions
  • Non-Taxable Events: Simply holding crypto-assets, moving funds between your own self-custody wallets, or receiving un-sold hard forks does not trigger taxation.
  • Mining and Staking Exclusions: Mining rewards, staking yields, DeFi interest, and lending returns are not covered by Article 20E. Instead, they are taxed as ordinary income upon receipt (up to 35% for individuals or the corporate tax rate of 15%), while any subsequent capital appreciation after receipt is subject to the 8% disposal rate.
  • Ring-Fencing and Loss Rules: Crypto disposal losses can only be offset against crypto disposal gains within the exact same tax year. Losses cannot be carried forward to future years, nor can they be offset against other income streams (such as salary, rental, or dividend income).

Tax Optimization Strategies Under the 200E Regime

1. Active Intra-Year Loss Harvesting

Because losses under Article 20E expire at the end of the calendar year and cannot be carried forward, active investors should review their portfolios ahead of December 31. If you have realized significant gains from crypto-to-crypto swaps or fiat sales earlier in the year, you can strategically realize underperforming positions before year-end to offset those gains and reduce your net 8% liability.

2. Structuring via a Cyprus Company

For high-volume traders or digital asset enterprises, operating through a Cyprus Company offers clean structural isolation.

  • Disposal Gains: Capital gains realized by the company fall under the flat 8% Article 20E rate.
  • Operational/Mining Income: Corporate business profits from services or mining are taxed at 15%.
  • Deductible Expenses: Companies can deduct legitimate operational overheads—such as server costs, software licensing, developer salaries, and legal fees—against their taxable income.
  • Non-Dom Interaction: Individual shareholders who qualify for Cyprus non-domiciled status continue to enjoy 0% Special Defence Contribution (SDC) on dividends extracted from the company, meaning personal tax leakage can be minimized when distributing net profits.

3. Timing Swaps and Fiat Realizations

Because a crypto-to-crypto swap constitutes a taxable disposal event under Article 20E (valued at the fair market euro value on the day of the trade), frequent rebalancing inside a personal wallet creates multiple small tax events. Consolidating trades or tracking cost-basis meticulously in EUR-equivalent terms prevents unexpected tax bills and ensures you accurately calculate net gains.

4. Compliance and DAC8 Readiness

Cyprus enforces strict transparency. Under the EU’s DAC8 directive, Crypto-Asset Service Providers (CASPs) report user transaction data, meaning reporting accuracy is mandatory. Using specialized crypto-tax software or maintaining clean transactional audit trails is essential to substantiate your acquisition costs against the 8% exit.
