Cyprus has transformed its digital asset landscape with the introduction of Article 20E into its Income Tax Law, effective January 1, 2026.

This landmark reform replaces an ambiguous historical approach with a clear, ring-fenced tax regime for institutional and retail crypto wealth, harmonized directly with the European Union’s Markets in Crypto-Assets (MiCA) regulation.

Core Pillars of Article 20E

1. The Flat 8% Disposal Rate

  • Tax Rate: Profits derived from the disposal of crypto-assets are subject to a flat 8% tax rate.
  • Scope: Applies equally to individuals and corporate entities that are Cyprus tax residents.
  • Ring-Fenced Nature: Crypto profits are calculated independently and are not added to general income streams, protecting investors from stepping into higher progressive personal income brackets (which peak at 35%).

2. What Counts as a Taxable Disposal?

Under Article 20E, a taxable event is triggered when you dispose of a MiCA-defined crypto-asset through:

  • Selling crypto-assets for fiat currency (e.g., EUR, USD)
  • Exchanging one crypto-asset for another (crypto-to-crypto swaps)
  • Using crypto-assets as a direct medium of payment for goods or services
  • Gifting or donating crypto-assets

Exemptions: Simply holding crypto-assets in a private wallet or transferring between self-custody wallets does not trigger a taxable disposal. Un-sold hard forks are also exempt.

3. Treatment of Mining, Staking, and Yield

Article 20E only covers capital-style appreciation upon disposal. Active and passive income-generating mechanisms are treated separately under general tax laws:

• Mining & Staking Rewards: Incur ordinary income tax rules at the moment of receipt—up to 35% for individuals or the standard 15% corporate tax rate for businesses (updated as part of the 2026 OECD-aligned corporate tax adjustments).

• Subsequent Appreciation: If mined or staked coins are later sold at a profit above their acquisition/receipt value, that subsequent capital gain falls under the 8% Article 20E rate.

4. Loss Relief and Restrictions

• Ring-Fenced Losses: Capital losses from crypto-asset disposals can only be offset against crypto-asset gains within the same tax year.

• No Carry-Forward: Unused crypto losses cannot be carried forward to future tax years, nor can they be surrendered via group relief mechanisms.

Institutional Structuring & Harmonization

Alignment with EU MiCA & DAC8

  • MiCA Definitions: By anchoring the tax code directly to EU Regulation 2023/1114 (MiCA), Cyprus eliminates local interpretive grey areas.
  • DAC8 Reporting: In tandem with Article 20E, the transposition of DAC8 enforces automatic exchange of information for Crypto-Asset Service Providers (CASPs), with initial compliance reporting cycles tracking calendar-year data.
  • Licensing: Businesses looking to operate institutional crypto structures in or through the island must coordinate compliance with the Cyprus Securities and Exchange Commission (CySEC) under MiCA licensing mandates.
  • Interaction with Non-Dom Status
  • Cyprus tax residents under the Non-Domiciled (Non-Dom) regime continue to enjoy 0% tax on dividends and passive interest.
  • However, lawmakers explicitly clarified that crypto disposal gains under Article 20E are not sheltered by traditional non-dom dividend exemptions, making the 8% flat rate a baseline requirement for active resident traders and institutional funds.
